Bomb hoax - Placing an article with Intent
There are two parts of the offence of placing an article with intent.
places an article in any place
The prosecution case is that ***.
The defendant denies this. He says ***.
with the intention of inducing in some other person a belief that the items were likely to explode or ignite and thereby likely to cause personal injury or damage to property
Criminals very rarely say out loud that they intend to commit a crime. So how do you decide what someone intends? The answer is that you can infer someone’s intention by looking at all the circumstances. Look at all the evidence and decide what, if anything, the defendant intended.
So, the key questions for you to answer in relation to Count *, having regard to all the evidence and the directions which I give you, are these
Did the defendant place *** ?
Did the defendant intend some other person to believe that the *** was likely to explode or ignite and thereby likely to cause personal injury or damage to the *** or any other item?
If you are sure the answer to both questions is “yes”, the defendant is guilty of Count *. If the answer to either question may be “no”, he is not guilty of Count *.
